Aminu Ogwuche, the suspected mastermind of the April 14, 2014 Nyanya bomb blast, which killed 75 persons yesterday had charges filed against him by the Nigerian police and the DSS struck out by Justice Adeniyi Ademola of the Federal High Court Abuja for want of diligent prosecution. And also due to the absence of the legal representative of the Inspector General of Police in court.
Justice Ademola in his reading said, ''The criminal charge is hereby struck out for want of diligent prosecution by the complaint, Inspector General of Police and his prosecution.''
The case had suffered several adjournment due to the failure of the police to produce the accused in court.
Ogwuche who filed a fundamental right suit against the Nigerian police and DSS had its requested granted. Justice Ademola ordered that his lawyers and family members should be given access to him. The court therefore said three lawyers from Ahmed Raji's firm and two members of the Ogwuche's family should be allowed access to the suspect. The case was adjourned till December 5,
The suspect's counsel, Ahmed Sani (SAN) in the suit filed is requesting the court to grant the suspect bail. He alleged that the Nigerian Police and the DSS was breaching his client's fundamental human rights by holding him endlessly and not charging him before a competent court.
